TERMS AND CONDITIONS
The following are the terms and conditions between your school, your company, or, if an individual, yourself ("You") and Weber Consultancy LLC ("We"/"Us"). Weber Consultancy LLC runs educational workshops, provides consultation support, and organizes other services for schools. We do not own schools, run transportation services, or offer any type of accommodation. ExamCoordinator.NET is a service (d/b/a) of Weber Consultancy LLC.
Agreement
By registering and paying to attend the ExamCoordinator.NET workshop, you enter into into a legally binding agreement with us under the laws of the State of Texas. As such, your booking with us will be binding on you and/or any employee whom you register for one of our events. The completing of an on-line booking and/or the payment of an invoice indicates your acceptance of your booking by Weber Consultancy LLC and your acceptance o these Terms and Conditions. Enrollment After registering and making full payment for our workshop event, you agree to complete our online application form within 14 days of the booking or sooner of the booking will begin within the 14-day period. We agree to provide the enrollee with workshop training, refreshments (at breaks), meals (where indicated), and accommodation (where indicated) as described on our event pages. Payment Payment should be made online through our website or by bank transfer. If you wish to make a bank transfer, you must register through our Direct Bill and Registration form. We will send you an invoice for your registration and payment will be due within 14 days or sooner of the workshop will begin within the 14-day period. No participant will be allowed to attend the workshop unless payment has been received in full prior to the start of the event. Participants are responsible for paying all bank fees related to the transfer of funds. We will send you a receipt of payment once the funds are received in our bank account. If you book a workshop at a reduced fee (i.e., early registration, regular registration, or sale items), payment must be made before this period is over, otherwise the new rate will be due. In all instances, payment must be received in full prior to the start of the workshop. Late Payments Because we make timely payments to our service providers, we expect the same in return from you. We will send a payment reminder if your payment is past due. After 15 days have passed, you will be assessed a $50 late payment fee. Participants who have not paid in full will not be eligible for a workshop certificate and/or access to login pages. Cancellations Made by You If you decide to cancel any part of your booking, before the workshop is confirmed, you must inform us in writing. Cancellations made during the early registration period will incur a $50 cancellation fee and cancellations made during the regular booking period will incur a $100 cancellation fee. All amounts will be refunded to you, less the cancellation fees. Cancellations made after the workshop is confirmed are non-refundable, though you may nominate an alternate participant to attend. Full payment is due whether or not you choose to send an alternate participant. No amount will be refunded in the event that a participant does not show up to the scheduled workshop event (no-show) after registration. Cancellations Made by Us Any of our workshops may be cancelled if sufficient bookings are not received and paid for at least four weeks prior to the start of the workshop. If we cancel any workshop or part of a workshop, you are entitled to a refund of all net payments received by us, but we will not be responsible for any travel or other expenses incurred. You are, therefore, advised to not make any non-refundable travel arrangements in relation to these workshops. Booking Changes Made by You A change of participant name is allowed at any point after registration. Changes of date and venue are permitted after workshop confirmation, but will incur a $200 rebooking fee. Booking Changes Made by Us If we have to make any changes to a workshop, we will inform you immediately and offer you an alternative workshop or a full refund less fees paid to us for that workshop. Limit of Liability We strongly recommend that you buy insurance to cover the cancellation by us of a workshop. We are not responsible for any costs associated with flight or travel cancellations. In the event that a workshop is cancelled because of insufficient bookings, we offer a full refund of the net fee received. If an event beyond our control occurs (e.g., the workshop leader falls ill, the venue is not available for some reason, etc.), we will attempt to run the workshop in another suitable leader or venue. If that is not practical, we will reimburse the full fee of the workshop, but no reimbursement of travel costs and no direct, consequential, or additional costs will be paid. |
Media Policy
We occasionally make photographic, digital, video, or film record our events; these records are only ever used for legitimate business purposes. Every person who attends our workshop events may have their photograph taken or be video recorded; these may, in turn, be used in promotional material, professional support, or as website/social media images, unless an individual gives us written notice before the event of their wish not to be photographed or recorded. By entering into this agreement, you agree that you (or participants from your school or company) may be included in any such recording and photograph or video used as described as above. At no time will the identity of the person in a photograph be available without the prior consent of that individual. Quite often, people ask us for copies of the photographs as souvenirs and we are happy to provide them. If, however, you believe that a photo or recording is being used by us in a way that is inappropriate and/or objectionable, you may request us to cease using the image or video in such a manner. Participant Behavior Our objective is to always provide a safe, enjoyable, and rewarding experience to all of our participants. In turn, we expect all attendees to be considerate of each other. It is, therefore, a condition of attendance that you agree that you and/or any participant sent by your school or company will behave responsibly throughout the event, paying due regard to the safety and wellbeing of other participants, the workshop leader, event venue property and staff, and Weber Consultancy LLC personnel. You and your attendees agree that you will refrain from any violence or inebriation during the workshop and will observe the general rules and regulations of the host venue, including in particular -- but without limitation -- any restrictions on smoking. Weber Consultancy LLC reserves the right to exclude from attendance at the event any individual whose behavior is perceived by us, in our absolute discretion, to be prejudicial to the safety of others or the proper and enjoyable running of the event. In the unlikely event of such an exclusion, no workshop fees or other expenses will be reimbursed or refunded and any unpaid fees will remain due and payable to Weber Consultancy LLC. Safety, Property, and Health Liability We use reasonable endeavors to choose appropriate venues for our workshops and, in conjunction with the workshop venue, appropriate catering and refreshments, and may from time-to-time assist with arranging local accommodation and transportation. Neither Weber Consultancy LLC nor its directors, officers, or agents are responsible for the safety and property of you and/or participants sent from your school or company in relation to travel to/from the venue, lodging, the workshop, or any excursions related thereto or for any financial losses incurred if the event is cancelled due to reasons beyond our control. Traveling to and from the workshop is the sole responsibility of you and/or the participants you send to the event. Neither Weber Consultancy LLC nor its directors, officers, or agents will have any liability in relation to you or your attendees for any damage to or loss of property or any financial loss arising therefrom. Neither Weber Consultancy LLC nor its directors, officers, or agents will have any liability of the death or of any personal injury to you or your attendees. Travel, Safety, Property, and Health Insurance In light of the above, you are strongly advised, for your own protection, to take out adequate health and accident insurance appropriate to the event to cover personal belongings and travel, providing adequate reimbursement for costs and expenses should the workshop be cancelled or transport be subject to any disruption or delay, or should you or your attendee be required to return home for any reason before the conclusion of the event. Collection and Use of Personal Data By entering into this agreement, you confirm that you are aware that Weber Consultancy LLC is required to collect certain personal data related to your attendance at our events, and that this data may be passed on to appropriate service providers (e.g., related to lodging, transportation, etc.). You further confirm that the personal information you voluntarily provide to us is true and correct. You further agree to the terms of our Privacy Policy. Severability The provisions of this Agreement are severable. In the event that any provision or part of any provision o this Agreement shall be held, in whole or in part, by any court of competent jurisdiction Governing Law and Jurisdiction This agreement and any non-contractual obligations arising from or in connection with this agreement shall be governed by and construed in accordance with the laws of the State of Texas. Each party irrevocably agrees that Texas courts shall have exclusive jurisdiction to settle any dispute or claim arising from or in connection with this agreement (including both contractual and non-contractual disputes or claims) and waives any objection to proceedings in such courts on the grounds of venue or on the grounds that proceedings have been brought in an inappropriate forum. |
